Please ensure you comply with our delivery location (site) requirements. At all times a forklift must be present to unload items upon delivery. No hand unloading by the delivery driver will be allowed under any circumstances. In the event of this not occurring, your bench tops may be returned to our warehouse and you (the customer) may incur additional freight costs.
We reserve the right to deliver ‘Goods’ by instalments. Any delivery times notified to you are estimates only. If you request us to postpone delivery of the ‘Goods’ beyond the delivery date or dates specified in your order, we may agree to do so if you agree to pay an additional fee for such postponement.
If we do not receive delivery instructions sufficient to enable us to dispatch the ‘Goods’ within fourteen (14) days of you being notified that the ‘Goods’ are ready for delivery, you shall from the fifteenth day after notification:
(a) be deemed to have taken delivery of the ‘Goods’;
(b) be liable for storage charges, payable monthly on demand;
(c) assume risk in the ‘Goods’.
When the ‘Goods’ have been delivered by Courier or Freight Company or by an Express Benches representative, once you, your employee or representative accept and sign the delivery docket, the ‘Goods’ will then be deemed to have arrived in perfect condition and you have then taken responsibility for the condition of the ‘Goods’ upon receipt.
If you, your employee or representative find any issues or concerns with the condition of the ‘Goods’ at the time of delivery, an Express Benches representative must be notified immediately by phone or email (email@example.com). Please share images and detailed explanation of areas of concern.
To the extent permitted by law, we will not be liable for any costs, loss or damage whatsoever (including indirect or consequential loss) caused by any delay or failure to deliver the ‘Goods’. Where such non-delivery or delay occurs, we may deliver the ‘Goods’ not delivered or delayed at any subsequent time and you must accept and pay for them.
Where we give a date of intended delivery, this will be subject to the ‘Goods’ ordered being available and our being able to make the delivery on that date.
Unfortunately we cannot offer a change of mind refund or exchange on the following items:
- Custom-made products
- Any product/s specifically cut to size at your request
These products can still be returned if they are faulty providing approval is obtained via a Express Benches Representative.
Our ‘Goods’ come with guarantees that cannot be excluded under the Australian Consumer Law. You’re entitled to a replacement or refund for a major failure, and you’re also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality but the failure does not amount to a major failure.
We will accept product returns and provide you with a replacement or repair where:
- The product is faulty or is not of acceptable quality deemed by our Express Benches Representative
We recommend you retain your receipt, as we may require proof that you purchased the product from us. Our Express Benches Representative will be able to advise you whether a repair or replacement is available, and may record your proof of identification when processing a return without proof of purchase.
